Handicap, reason for authorization

“Child’s state of health or disability” is one of the four grounds for permission listed in the August 2021. Act. Fortunately, because for many parents of children with disabilities, homeschooling has become crucial after the failure of schooling.

However, they must fill out a Cerfa form and attach several documents: an identity document for the child and those responsible for it; proof of address; and the decisions of the Commission on the Rights and Autonomy of Persons with Disabilities (CDAPH) concerning school careers (see box below) or, if no decision has yet been made, the medical certificate that you have provided to MDPH in your application folder.

Permission for three years

The professional director of the Statens Uddannelsesservice (Dasen) then sends the doctor’s statement in a sealed envelope to the school doctor. It is up to the latter to issue an opinion on the request. The dose should give its answer within two months. Beyond this period, his silence is worth accepting. The authorization can be given for a maximum of three school years, which can be extended for as long as necessary.

Full permission for children already at home

“I do not expect a lot of rejection issues over the next few years, predicts Marion Aubry, vice president of the Toupi Association. Many families have a legal permit until 2024 if their child was already in the IEF. »

Parents who were already in homeschooling in 2021/2022 will benefit from automatic authorization for 2022/2023 and 2023/2024 when the results of their last education check have been assessed as adequate. They do not have to present a decision from CDAPH or a medical certificate. All you have to do is fill in a specific Cerfa form.

An important step for Cned

In addition, the permission given by Dasen to raise a disabled child in the family is now worth a positive statement for registration at the National Center for Distance Education (Cned). “For full class courses with regulated registration at Cned, you must now request a family instruction authorization”adds Marion Aubry.

A limited dispensation during the school year

In any case, for 2022-2023, families must submit their application to Dasen by 31 May. Then it’s too late. In its opinion on the draft decree, the National Advisory Council for People with Disabilities deplored this lack of flexibility. “We know that the situation of children with disabilities may require changes during the year”he remarked.

However, it will still be possible to request an extraordinary authorization during the school year, possibly “the reasons for the child’s state of health or disability (…) were set out in the application submission plan », says the ministry. Or if “the child’s physical or moral integrity is threatened”. This may be the case in cases of bullying or school phobia. What about administrative phobia?

What decision was made by CDAPH?

The wording can be confusing. Yes, the decision of the Commission on the Rights and Autonomy of Persons with Disabilities (CDAPH) concerning the schooling of the child must be attached to the application for permission to teach at home. But no, this is not a homeschooling decision. This is not CDAPH’s responsibility. Any message (reference to a regular school, an Ulis, an IME, etc.) merely serves to confirm that the child is actually recognized as disabled. And that the reason for the disability for the request for family education is therefore well-founded.
